Video: How to participate in the Canadian Credit Index (CC Index)

Welcome to the CIC e-Newsletter - Summer 2010

Editor's Message

It's finally time for those lazy, hazy, crazy days of summer.  We hope this summer edition of To Your Credit finds you well and ready for some R & R—relaxation and reading.  We've assembled a pot pourri of informative summertime reading.  Don’t forget to read the message from Peter Finlay, CCP, President and Dean on recent Executive Committee appointments, the profile of National Board Director and Education Committee Co-chair, Dana Swekla, as well as updates from our members on the move.

The business articles focus on the economy, doing business in China, and that ever present menace, the fraudster.  Our legal articles focus on the enforcement of judgments, both inter provincially and internationally.  On the personal development side, we have some tips on how to be a more effective negotiator, and how to overcome fears of public speaking—a very common phobia.

If you're curious about the CC Index and want to learn how it works, please click on the side bar video link.

As always, we want to hear from our members and welcome your comments and suggestions for future articles.

Happy reading,
Reggie Delovitch

The Interprovincial Enforcement of Judgments
by Michael N. Bergman, B.C.L./L.L.B McGill University
A Creditor and a Debtor enter into a financial agreement in Alberta. After several years, the Debtor moves to Manitoba, leaving behind only sparse assets, (not nearly enough to cover the costs owed) in Alberta. Following a slowdown of repayments, the Creditor decides to take legal action against the Debtor in the Alberta Court of the Queen’s Bench. A favourable ruling for the Creditor grants him access to the Debtor’s limited Alberta assets. However, is it at all possible for the Creditor, in using the ruling of the Alberta court, to have access to the Debtor’s Manitoba assets? In other words, what jurisdiction do provincial courts have in enforcing interprovincial matters? ...

Suing a Foreigner? Keep Control of the Case with a Forum Selection Clause
by Ken MacDonald, LL.B., LL.M.
In the world of cross-border litigation, I can tell you that prevention is worth much more than a pound of cure. Battles over where a case is to be litigated are common, and can be so protracted and costly that the parties never reach a determination of the merits of the case...
